These Terms are an agreement between you and Cuap ("we", "us") covering your use of the Cuap iPhone app, the Cuap web app and related services (the "Service"). Our Privacy Policy explains how we handle your data and is part of these Terms. If you don't agree to these Terms, please don't use Cuap.
Nobody reads these. You're reading this. That makes you my favourite person. Don't tell your person.
02Who can use Cuap
You must be at least 13 years old, or older if your country's age of digital consent is higher, and able to form a binding contract. If you're under 18, a parent or guardian must agree to these Terms for you. You may not use Cuap if the law prohibits you from doing so.
03Your account
Your account lives on your devices: each phone or browser holds its own keys, and you can add a computer by scanning a code with your phone. You can also sign in with Apple, so your account can move to a new iPhone. You're responsible for what happens on your account, and for keeping your devices and Apple ID secure. If a device goes missing, remove it in Settings → Privacy. Your invite code works like a key: anyone who has it can join your feed while there's still an empty seat. Only share it with the person you mean to invite. If you think someone has got into your account, tell us right away.
Six characters. One seat. Do not post your code on the internet. I've seen things.
04Your content
You own what you post: text, photos, stamps, notes and reactions ("Your Content").
Your Content is end-to-end encrypted on your device before it reaches us, so what we hold is a scrambled copy we can't read. So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy and transmit that encrypted copy. We use it only to deliver Cuap to you and your person, and the licence ends when Your Content is deleted from our systems (see the Privacy Policy for timing). We don't use Your Content for advertising or to train AI models.
You promise you have the right to post Your Content, and that posting it doesn't break these Terms or anyone else's rights.
05The rules
Don't use Cuap to:
break the law, or help someone else break it;
harass, threaten, stalk or abuse anyone, including your person;
share intimate images of anyone without their consent, or any sexual content involving minors (we report this to the authorities);
infringe someone else's copyright, trademark, privacy or other rights;
send malware or spam, or try to get into feeds, accounts or systems that aren't yours;
reverse-engineer, scrape, overload or interfere with the Service, or get around its security rules;
pretend to be somebody you're not.
Basically: be the kind of person someone would want to share a feed with.
06Your person & reporting
A feed is shared. Whatever you post can be seen, saved, screenshotted or forwarded by your person, and we can't control what they do with it once they've seen it. Deleting a post removes it from Cuap, but it can't un-ring the bell.
Leaving. You can leave a feed at any time. That's the block button: once you leave, your person can't reach you there any more, your posts in it are deleted, and nobody can ever rejoin that feed.
Reporting. If your person breaks these rules, report them from the app. You can choose to attach the posts that show the problem. Because feeds are end-to-end encrypted, we can't see what's said unless you show us, so we don't and can't monitor feeds. When we get a report, we may warn the account, limit it, close it, or report it to the authorities when the law requires (always for child sexual abuse material). We aren't responsible for how users treat each other, but we take reports seriously.
I can eat your posts. I cannot eat their memory of your posts. Biology is cruel.
07Our stuff
Cuap, its design, code, name, logo and the bird belong to us and our licensors. While you follow these Terms, we give you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, as Apple's App Store rules allow. Using the web app is fine too. If you send us feedback, we may use it freely and without paying you.
08Cuap Plus
Free and Plus. Cuap is free for up to two feeds. Cuap Plus is an optional subscription that adds more feeds and the Plus sticker pack, and we may add more to it over time. One subscription covers both people in a feed: if either of you has Plus, you both get it in the feeds you share. If the person paying leaves or stops paying, it ends for both of you. Nothing you've already posted is deleted when Plus ends, but you can't start new feeds beyond the free allowance.
Billing. Plus is billed monthly or yearly, at the price shown before you buy, including any taxes that apply. It renews automatically at the same price for the same period unless you cancel at least 24 hours before the current period ends. If there's a free trial, you're charged when it ends unless you cancel before then.
Bought on iPhone: Apple handles the payment, and Apple's Media Services Terms apply. Manage or cancel it in iPhone Settings → your name → Subscriptions. Refunds are handled by Apple under Apple's policies. Deleting the app or your Cuap account doesn't cancel it.
Bought on the web: Stripe handles the payment. Manage or cancel it any time from the billing page in the web app. Cancelling stops the next renewal, and Plus keeps working until the end of the period you've paid for. Deleting your Cuap account cancels it automatically.
Withdrawal (EU/UK). If you buy on the web as a consumer in the EU or UK, you normally have 14 days to withdraw. Because Plus starts straight away, we ask you to agree to that at checkout, and you acknowledge that you lose the right to withdraw once it has started, as the law allows. This doesn't affect your other rights as a consumer, such as a refund if Plus doesn't work as described. On iPhone, Apple's refund process applies instead.
Price changes. If we change the price, we'll tell you in advance, and the new price applies from your next renewal. Where the law or the App Store requires it, we'll ask you to agree to the change first. If you don't want to pay the new price, you can cancel before it takes effect.
09Ending things
You can stop using Cuap at any time, leave any feed, and delete your account yourself in Settings → Privacy → Delete my account (or email hello@cuap.app). If we end your access because you broke these Terms, we don't refund the rest of a paid period, unless the law requires it. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we shut down the Service. Unless it's an emergency or a legal matter, we'll try to warn you first. If we ever shut down, we'll give reasonable notice so you can save what matters. Sections 4 (licence aside), 7, 10, 11 and 12 survive termination.
It's not you, it's… no, okay, if you're here because of section 5, it's you.
10No guarantees
Cuap is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted, error-free or secure, or that content will never be lost. Keep copies of anything precious.
Cuap is not a relationship counsellor, an emergency service or a backup service.
11Liability
To the extent the law allows, Cuap won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of what you paid us in the 12 months before the claim and USD 50.
Some places don't allow these limits. If you live in one of them, the limits apply only as far as your law permits. Nothing in these Terms limits liability that can't be limited by law, or takes away your statutory rights as a consumer.
If you missed a post and it caused an argument, that's between you two. I'm just a bird.
12Legal bits
Changes. We may update these Terms. If a change is significant, we'll tell you in the app before it takes effect. If you keep using Cuap after that, you accept the new Terms.
Apple. These Terms are between you and us, not Apple. Apple isn't responsible for the app or its support, and Apple and its subsidiaries are third-party beneficiaries of these Terms who may enforce them.
Governing law. These Terms are governed by the laws of the country where Cuap is established, without regard to conflict-of-law rules. If you're a consumer, you also keep the protection of the mandatory laws of the country you live in, and you can bring claims in your local courts.
The whole agreement. These Terms and the Privacy Policy are the entire agreement between us. If any part turns out to be unenforceable, the rest still applies. If we don't enforce something straight away, we haven't waived it. You can't transfer these Terms without our consent. We may transfer them as part of a merger or sale.
